Welcome to Hyper Inkers Tattoo Studio. By accessing our website hyperinkers.com or utilizing any of our tattoo services, you agree to be bound by these Terms of Service. These Terms establish the legal framework governing your relationship with the Studio, designed to protect the interests of both parties and ensure a positive and safe experience.
Acceptance and Modification of Terms
Acceptance: Your use of the Website or booking of Services signifies your full understanding and acceptance of these Terms.
Modification: We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. We encourage you to review this page periodically for updates. Your continued use of the Website or Services after modifications constitutes your acceptance of the revised Terms.
Eligibility & Client Responsibilities
Age Requirement: In compliance with state regulations, you must be 18 years of age or older to receive tattoo Services. No exceptions will be made, even with parental consent. You must provide valid, government-issued photo identification (e.g., Driver’s License, Passport, State ID) at the time of your appointment for age verification.
Health & Disclosure:
You are responsible for truthfully and fully disclosing any medical or health conditions that could affect the tattooing process or healing, as outlined during the consultation or consent process. This includes allergies, skin conditions, communicable diseases, heart conditions, bleeding disorders, and relevant medications.
Pregnancy: We reserve the right to refuse service to individuals who are pregnant.
Breastfeeding: While generally considered safe, we advise clients who are breastfeeding to consider waiting until their child is older (e.g., 9-12 months) for their own safety and comfort during the procedure and healing process. Please discuss this with your artist.
We are not liable for any complications arising from your failure to disclose or providing inaccurate health information.
Sobriety: You must arrive sober and not under the influence of alcohol, illegal drugs, or impairing substances. Providing Services to individuals under the influence is prohibited. We reserve the right to refuse service without refund or deposit retention if we suspect you are under the influence.
Studio Environment: You agree to maintain respectful conduct towards our staff and other clients. We strive to maintain a clean, safe, and professional environment following all recommended hygiene guidelines.
Appointments, Deposits, and Cancellations/Rescheduling
Punctuality: Please arrive exactly at your scheduled appointment time. Arriving early may require you to wait in the designated lobby area to ensure artists can focus on current clients.
Deposits:
A non-refundable deposit is required to secure your appointment slot. The specific deposit amount and payment instructions will be provided during the booking process.
Deposits can typically be paid online via Cash App, Zelle, or PayPal.
The deposit amount will be deducted from the final cost of your tattoo Service.
Deposit Forfeiture: Your deposit secures your time slot and covers the artist’s preparation time. The deposit will be forfeited if you:
- Cancel or reschedule with less than 72 hours’ notice.
- Arrive more than 30 minutes late for your appointment without prior communication.
- Fail to show up for your appointment (no-show).
- Fail to provide valid ID for age verification.
- Arrive under the influence of drugs or alcohol.
Cancellations & Rescheduling:
- If you need to cancel or reschedule, please provide at least 72 hours’ advance notice by calling us at (210) 997-9737.
- With sufficient notice (72+ hours), your deposit may be transferred to a rescheduled appointment one time, subject to artist availability.
- Failure to provide 72 hours’ notice will result in the forfeiture of your deposit, and a new deposit will be required to book another appointment.
Lateness:
- If you anticipate being late, please notify us as soon as possible.
- If you are more than 15 minutes late without notification, we will attempt to contact you.
- If you are more than 30 minutes late without notification, your appointment will be considered cancelled, and your deposit will be forfeited.
Services & Payment
Service Description: Hyper Inkers Tattoo Studio offers artistic tattoo services. Details regarding styles and artists may be available on the Website.
Pricing: Service costs may be determined hourly, per piece, or based on a specific quote. Pricing will be discussed and agreed upon with you before the Service begins.
Payment:
- The remaining balance (after deducting the deposit) is due in full immediately upon completion of the Service.
- Preferred payment methods are Zelle or cash.
- We also accept credit/debit cards, however, please note that card payments are subject to a 3% transaction fee.
Tipping: Tipping is not required but is greatly appreciated by our artists for their dedicated work. Tips can be made using any of the accepted payment methods (Cash, Zelle, Card).
Studio Conduct & Guest Policy
Guests: To ensure a focused and safe environment for both clients and artists, we limit guests. You may bring one guest (18 years or older) for support if needed. Your guest must wait in the designated lobby area during your tattoo session and may not enter the tattooing area unless specifically permitted by the artist for brief moments. Extended tattoo sessions can be lengthy, and the studio environment is not always suitable for waiting guests.
No Minors: For safety and insurance reasons, individuals under the age of 18 (including children and infants) are strictly not permitted inside the studio at any time. Please make necessary childcare arrangements prior to your appointment.
Studio Rights
Right to Refuse Service: We reserve the right to refuse service to anyone, at any time, for reasons including but not limited to: failing age verification, appearing under the influence, undisclosed or high-risk health conditions, requesting designs that violate our standards, or exhibiting inappropriate/disruptive behavior.
Use of Artwork Images: You consent to the Studio taking photographs/videos of your completed tattoo and using these images/videos for promotional purposes (portfolio, Website, social media). We will strive to maintain your anonymity where appropriate.
Website Use & Intellectual Property
License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes in accordance with these Terms.
Prohibited Uses: You may not use the Website for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the site.
Intellectual Property: All content on the Website (“Studio Content”) is the property of Hyper Inkers Tattoo Studio or its suppliers and protected by intellectual property laws. You agree not to copy, modify, or exploit any Studio Content without express permission.
User Submissions
By submitting content (e.g., comments, feedback) to our Website, you grant Hyper Inkers Tattoo Studio permission to use, reproduce, and display such content in connection with our business operations. You warrant that you own the rights to any content you submit.
Disclaimers
Website: The Website content is provided “as is” without warranty of any kind. We disclaim all warranties regarding the accuracy, reliability, or timeliness of Website content.
Tattoo Services: We adhere to strict hygiene protocols using sterile, single-use equipment. However, tattooing involves inherent risks. We are not liable for unforeseen allergic reactions or complications arising from the client’s failure to disclose health conditions or follow aftercare instructions. We aim for artistic excellence but are not responsible for subjective dissatisfaction if the tattoo matches the approved design.
Limitation of Liability
To the maximum extent permitted by law, Hyper Inkers Tattoo Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or Services.
Indemnification
You agree to indemnify and hold harmless Hyper Inkers Tattoo Studio from any losses, costs, liabilities, and expenses arising from your use of the Website/Services or your violation of these Terms.
Termination/Access Restriction
We reserve the right to terminate your access to the Website or Services at our discretion, particularly for violations of these Terms.
Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Texas, USA. Disputes shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled in the courts of Bexar County, Texas.
Miscellaneous
- Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control.
- Entire Agreement: These Terms, along with the Privacy Policy and any signed consent forms, constitute the entire agreement between you and the Studio.
- Severability: If any provision is deemed invalid, the remaining provisions shall remain in effect.
- Relationship: These Terms do not create a joint venture, partnership, employment, or agency relationship.
